VILLA RENTAL AGREEMENT - RESERVATION, PAYMENT, CANCELLATION CONDITIONS AND REFUND CONDITIONS
PARTIES AND OBJECTIVE
This contract; KEYSAN TURİZM BİLGİS.TİC.TEK.GIDA OTO KİR.İNŞ.TAAH.İTH.İHR.ve PAZ.LTD.ŞTİ The activity center that rented the villa (here in after referred to as CUSTOMER) and the activity center that leased the villa is Tufan Caddesi No: 38 Dalyan Mahallesi Ortaca MUĞLA (here in after referred to as KEYSAN VİLLA.) Due to the rental of VILLA for the dates previously specified.
Between the parties, in the process that starts with the transmission of the rental request via the website, by e-mail or by phone, they agree, approve and electronically sign this electronic agreement by agreeing on the following terms. (Payment information mails sent through the site and credit card payment pages contain confirmation warnings and checkboxes indicating that this agreement has been read and approved. The failure to read the agreement despite such warnings is entirely under the responsibility of the CUSTOMER and such defenses do not affect the validity of the following conditions.)
The customer who makes a reservation for one of our villas through our website www.keysan.com.tr will be deemed to have accepted all of the following conditions in advance. In cases where any of the following conditions are violated, it is possible to cancel the reservation made to KEYSAN VILLA unilaterally, to ask the customer to leave the villa, to not return the deposit, deposit rental fee received by KEYSAN VILLA and to demand the remaining rental fee.
RESERVATION AND PAYMENT
Our villas can be pre-booked via the online reservation page on our website or by phone or e-mail. After determining the dates, the necessary contact and invoice information is received from you and pre-lease is made. After the pre-lease, 25% of the total price for the villas, that is, the down payment is made by the customer. If the deposit will be done by EFT method, it must be paid within 1 business day after pre-lease. Confirmation and rental agreement is not sent without making payment via credit card or mail order method on our online website and the reservation request that is not completed after 24 hours is automatically deleted by the system. After the deposit is received, we will be sent a written villa rental / accommodation agreement document. This document will contain information on the date and method of the deposit / payment, as well as the dates on which the villa was rented on your behalf.
If the deposit is not paid, KEYSAN VILLA will have the right to cancel the pre-rental reservation without informing the customer.
The remaining fee of the villa is made to the attendant who handed the villa key to you by cash or credit card as soon as the check in contract is signed and you check the villa you rented.
The entrance time of the customer to the villa is 16:00.(The earliest checkin request depending on availability, sometimes flexibility may be shown but not guaranteed). Customer; They cannot enter the villa before 16:00. The customer's departure time from the villa is 10:00 in the morning at the latest. (There may be flexibility in cases where there is no entry on the same day, but such a guarantee cannot be given) In cases where an early exit is desired, it is obligatory to inform KEYSAN VILLA 24 hours in advance. In cases where the customer leaves the villa he rented voluntarily before the end of the reservation, the customer is not refunded for the rental fee.
The number of people above the capacity specified on our website or the number of people specified while making the reservation will not be accepted. Children over 3 (three) years old are considered as persons. After the reservation is made, it is obligatory to notify KEYSAN VILLA in writing if the customer wants to make any changes in the number of persons. The number of people above the total bed capacity of the villa will not be admitted to the villa. It is absolutely not possible to accept guests after entering the villa. If it is determined that there are more people and unregistered guests, KEYSAN VILLA will have the right of the customer to leave the villa and to request the entire fee. The customer is deemed to have accepted that all the information he has provided is complete and therefore all liabilities arising from it.
Identity information of all persons who will stay at the time of entry to the villa is determined by photocopying identity document/passport and notifying the security forces, persons who do not have a valid identity document / passport will not be admitted to the villa.
VILLA MAINTENANCE CLEANING AND EXTRAS
Our villas are delivered to our customers as cleaned and disinfected before they enter. For our customers staying for 2 (two) weeks or more, free cleaning and change such as towels / sheets are made once a week. The day and hour of the arrival of our cleaning staff is discussed and agreed with the customer in advance. In addition, garden and pool maintenance is done by us early every morning.
If there is any problem in the villa, this problem will be resolved by KEYSAN VILLA. In order to eliminate such services, the personnel should be allowed to enter the villa or garden by the customer. Unless otherwise stated on our website, internet, water, electricity, tube prices are included. Our company is not responsible for electricity, water, internet etc. outages rarely caused by service providers.
PET / SMOKING
Unfortunately, our pets are not allowed in our villas. KEYSAN VİLLA can claim and compensate the damages caused by the pets taken into the villa without our knowledge. Smoking is prohibited in all indoor areas of our villas. If these two situations are otherwise, KEYSAN VILLA may request the customer to leave the villa and create the right to make no refund.
The villa rental prices stated on our website are overnight accommodation. It is made with the system of deposit money transfer, EFT, Card payment. Our prices include VAT and all subsequent taxes.
RESERVATION, PAYMENT, CANCELLATION AND REFUND TERMS
After the prepayment is made for the villa, the villa is reserved for the customer. The customer has the right to cancel free of charge within the first 24 hours after making a reservation. All cancellation requests should be sent to KEYSAN VİLLA in written form by e-mail. Cancellation requests after 24 hours are processed within the cancellation and refund conditions stated below. KEYSAN ViLLA collects 25% of the total price as a down payment / prepayment at the time of reservation.
This prepayment is non-refundable, but the date can be changed within the dates specified below. Date change is only possible if the villas are available.
25% of the total rental fee for cancellation requests up to 60 days before the start of the reservation
50% of the total rental fee for cancellation requests up to 30 days before the start of the reservation
KEYSAN VILLA is entitled to request 100% of the total rental fee for cancellation requests received less than 30 days before the start of the reservation.
Sales made during early booking discount periods are paid in full and are non-refundable, subject to the full payment of the total rental fee. KEYSAN VİLLA does not make any refunds for such sales. However, a change of date can be requested for this reservation up to 60 days before the start of the reservation. All requests are met according to the availability of our villas.
In cases where the rental fee has been collected 100%, considering the periods mentioned above, if the right to pay has arisen, it will be refunded with the payment method made by the customer after deducting the costs.
Payments received by credit card are strictly non-refundable in the form of cash, because it is also prohibited by law according to the regulations of the Interbank Card Center. This payment return to your same card number to use payment time.
When there are multiple sales for the same date on online sales platforms, a reservation is created for the first transaction as date and time, and an alternative date or alternative villa is recommended to the customer for other reservation requests. In cases where it is not accepted by the customer, no fee is requested from the customer and the payments made, if any, are returned.
In cases where the customer does not make the remaining payment on time, KEYSAN VILLA has the right to cancel the reservation and not to refund the fee previously paid by the customer and to rent this province to someone else. Reservation cancellations are made in writing, otherwise cancellations are not valid. The reservation cancellation letter becomes valid after KEYSAN VILLA receives in its mail.
If the renter requests cancellation for reasons that can prove indispensable for death, illness, wedding cancellation, etc., will sent you cancellations letter and invoice with cancelations cost. You will be claim this cost from your travel insurance agency.
RESERVATION DATE CHANGE
You have the right to change the date in the reservation, but the requests received within the date range of the cancellation conditions stated above are evaluated according to the availability of our villas. The right to speak on this subject belongs to KEYSAN VİLLA.
It is recommended that the CUSTOMER take out travel insurance through an insurance agent in case of adverse events that may be experienced during his travel. Villas are covered by general insurance (earthquake, theft, fire, etc.), but the persons covered by this insurance are not covered. Therefore, in any case, the insurance will not compensate your damages.
Travel insurances also compensate the damages you incur in case of illness, death, flight cancellation etc.
KEYSAN VİLLA cannot be held responsible for personal damages due to lack of insurance. The CUSTOMER cannot be held responsible for the fixed fixtures subject to insurance stolen from the houses, either.
The temperatures of the swimming pools in our villas may vary depending on the weather conditions. KEYSAN VİLLA cannot be held responsible if the customer cannot use the swimming pool in cases such as cold weather. The swimming pools in our villas are kept open between 1 April and 31 October and daily cleaning and maintenance is done by us. Our company cannot be held responsible if the swimming pool is closed for your stays outside these periods.
OUR RESPONSIBILITIES AND WARRANTY
KEYSAN VILLA is responsible for delivering the villa to the CUSTOMER in a clean and ready-to-use condition. If there is any broken, non-working item or any malfunction at the entrance to the villa, the CUSTOMER has the right to report this situation to KEYSAN VILLA and request that the problems be resolved. KEYSAN VİLLA should ensure that this problem is resolved within 48 hours at the latest. The customer does not have the right to demand a claim for the service he cannot receive due to any malfunction that he has not notified to KEYSAN VILLA.
RESPONSIBILITIES OF THE CUSTOMER
The CUSTOMER agrees to use and protect the entire house and all kinds of items in it as carefully as his own house. The CUSTOMER is fully responsible for possible damages in the rented house during the rental period due to his own fault or negligence. This responsibility of the CUSTOMER includes the possible damages that may occur due to the fault or negligence of other persons accompanying it. Failure to claim the amount of damage when the CUSTOMER leaves the house does not mean that the damage amount has been waived. In the event that the damage is detected and proven in the process after leaving the house, the CUSTOMER is still obliged to pay the damage. However, for this, the parties must have made a verbal agreement about the damage at the exit or it must be proved. The CUSTOMER is obliged to avoid behaviors that may disturb the house and its surroundings. As a result of the complaints from the environment or the complaints made by the security forces, a warning is given first, in case of repetition, the host has the right to remove the CUSTOMER from the house and the payment will not be refunded.
The CUSTOMER is directly responsible for the penalty obligations imposed by the local powers in cases of environmental disturbances, etc., given by the Customers, together with the people next to them. CUSTOMER must comply with the general laws in the rented house. In case of non-compliance, the CUSTOMER is directly responsible with the people next to him.
Our company is a corporate company and invoices every price in return for the lease it receives from the CUSTOMER since it rents out its own villas. If you submit your Corporate Invoice requests and invoice information at the time of booking, your fee will be presented to you as issued at the end of your stay, or if an e-archive invoice is issued, it will be sent to your e-mail address.
KEYSAN VİLLA may terminate this contract unilaterally without any legal liability in cases that fall within the scope of force majeure. War in the region or in the country, war threats, riots, strikes, natural disasters, fires, terrorist activities, epidemics, technical problems that may occur in transportation, superstructure and infrastructure works carried out by municipalities or public institutions, which cannot be prevented by KEYSAN VILLA, officials in the region and all events that cannot be foreseen and occur beyond our control will be evaluated within the scope of force majeure.
All complaints about the villa by the customers during their stay in the villa will be taken care of by KEYSAN VILLA and necessary solutions will be produced. KEYSAN VİLLA will not be held responsible for any complaints that are not notified during the stay, and that will be made after the accommodation and leaving the villa.
ORTACA Enforcement Offices and ORTACA Courts are authorized in all disputes that may arise regarding the matters covered by this agreement.
